Terms of Use — Ozdir

1. Acceptance of terms

These Terms of Use ("Terms") govern your access to and use of ozdir.com.au (the "platform"), operated by Ozdir.com.au ("Ozdir", "we", "us" or "our"). By accessing or using the platform you agree to be bound by these Terms. If you do not agree, please do not use the platform.

2. Eligibility and accounts

You must be at least 18 years old to create an account. You are responsible for the accuracy of your account details and for keeping your login credentials secure. You are responsible for activity that occurs under your account.

3. Our services

Ozdir is an online directory that helps people discover Australian businesses and trade services. We provide the platform on which listings appear; we do not provide the services advertised in listings and do not endorse, guarantee or warrant any listed business. We may modify, suspend or discontinue features at any time.

4. User conduct

You agree not to:

Submit false, misleading, or fraudulent information
Post unlawful, infringing, defamatory or offensive content
Impersonate any person or business, or list a business without authority
Use the platform to send spam or harvest data
Interfere with, disrupt or attempt to gain unauthorised access to the platform

5. Business listings and content

You are responsible for the content you submit and warrant that you have the right to submit it and that it is accurate. Listings may be reviewed before publication and we may decline, edit or remove any listing at our discretion, for example where it breaches these Terms. By submitting content you grant us a non-exclusive licence to host, display and distribute it for the purpose of operating and promoting the directory.

6. Intellectual property

The platform, including its design, text, graphics and logos, is owned by Ozdir or its licensors and is protected by law. You retain ownership of content you submit, subject to the licence in clause 5.

7. Fees and payment

Basic listings may be offered free of charge. Enhanced or promotional features may be offered for a fee, which will be disclosed before purchase. Fees are stated in Australian dollars and may be inclusive of GST where applicable. Payment terms, renewals and refunds (if any) will be set out at the point of purchase.

8. Disclaimers

The platform and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties not expressly stated in these Terms. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by law, and subject to any non-excludable rights under the Australian Consumer Law, Ozdir is not liable for any indirect, incidental or consequential loss arising from your use of the platform or reliance on any listing.

10. Indemnity

You agree to indemnify Ozdir against claims, losses and costs arising from your breach of these Terms or your misuse of the platform.

11. Termination

We may suspend or terminate your access if you breach these Terms. You may close your account at any time.

12. Governing law

These Terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.

13. Changes to these terms

We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
